About these terms

These terms apply when you visit smelted.ai, browse our marketplace or send us a form. By using the site, you agree to them. If you don’t agree, please don’t use the site.

In these terms, we, us and our mean Smelted.

Who we are

Smelted represents companies that want to license internal records or source code to AI labs and other data buyers. We call these companies sellers. We act as the seller’s agent. Smelted is not a buyer of data, a broker-dealer or a reseller.

We list each seller’s data anonymously on our marketplace, review requests from buyers and introduce approved buyers to the seller. The buyer and seller then sign an NDA directly with each other. The seller shares any sample and delivers data directly to the buyer. Smelted never receives, stores or processes a seller’s datasets.

Sellers pay us a success fee when a deal closes, under a separate signed agreement. Advisors and investors who refer companies to us may receive a share of our fee under a separate referral agreement.

The site is for information

The site, our guides and the marketplace are for information only. They are not legal, tax or financial advice.

Listings and valuations

• A listing describes data that a seller may license. A listing is not an offer, and you can’t accept it to form a contract.
• Valuation ranges on the site and in our messages are estimates. They are not offers or guarantees.
• We don’t guarantee that any data will sell, what price it will reach or how long a deal will take.

Buyer terms

You can request access to learn more about a listing. We review every request and may decline any of them.

Anyone who receives listing details from us agrees to two things:

1. You’ll keep listing details confidential.
2. For 24 months after Smelted introduces you to a seller, you’ll deal with that seller about their data only through Smelted.

Buyers confirm both by ticking a box on every access request. The second promise is called non-circumvention. You can still talk to the seller directly once we introduce you. Any deal for that seller’s data during those 24 months goes through Smelted.

Deals have their own agreements

Any actual deal is governed by separate signed agreements, such as:

• the seller’s agency agreement with Smelted;
• the NDA between the buyer and the seller; and
• the data license between the buyer and the seller.

Partners who refer companies to us do so under a separate referral agreement. If any of these agreements conflicts with these terms, that agreement wins.

Acceptable use

When you use the site, you agree not to:

• scrape the site or the marketplace, or copy listings with bots or other automated tools;
• attack the site, try to break into it, overload it, or get around its spam protection or limits; or
• give us false information or pretend to be someone else.

We may block anyone who breaks these rules and decline their requests.

Our content

The content on this site belongs to Smelted. This includes the text, guides, design and logo, and the way we present listings. You’re welcome to read it and share links to it. Please don’t copy or republish it without our permission.

The site is provided as is

We provide the site and the marketplace as is and as available. We don’t promise that they will always be available, free of errors or complete.

Limits on our liability

As far as the law allows, we are not responsible for losses that come from using the site or relying on what it says. This includes lost profits, lost deals and missed opportunities.

Nothing in these terms limits any liability that the law doesn’t allow us to limit. The separate agreements for a deal set out who is responsible for what in that deal.

Changes to these terms

We may change these terms. When we do, we update the date at the top of this page. If you keep using the site after a change, you accept the new terms.
